Blue Caribbean Belize Management Rental Agreement

Terms and Conditions

1. PROPERTY:  The property is located at 3.5 miles South, San Pedro Town, Ambergris Caye, Belize. The property is furnished and includes full kitchen, laundry room, linens, bath towels, & beach towels.
2. MAXIMUM OCCUPANCY:  Maximum occupancies are listed for each condo individually. Any guests beyond this limit will not be permitted to stay without prior permission.
3. MINIMUM STAY:  This property requires a 3 night minimum stay. Longer minimum stays may be required during holiday periods.
4. RENTAL RULES:  Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.
5. ACCESS:  Guest shall allow Property Management access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
6. CHANGES & REFUNDS:

  • 30 or more days prior to the date of arrival: Full Refund
  • Less than 30 to 14 days out: 50% deposit refund
  • Less than 14 days out: No refund
  • Peak season: No refund 30 days or less prior to arrival
  • Refunds will not be given for nights unoccupied due to late arrival, flight delays,
  • In the event of a refund, a 3% Processing fee will be deducted

7. INSURANCE: We encourage all renters to purchase traveler insurance. 8. RENTAL RATES & FEES:

  • 50% deposit required at time reservation is confirmed. All fees listed are in US
  • Full pre-payment due to reservation office 30 days prior to
  • A credit card will be kept on file to cover damage or loss as a result of guest *
  • An inventory of condo contents can be provided to the guest at check-in.
  • Any charges related to guest damage will be posted within 7 days of checkout pending post occupancy

*If the premises appear dirty or damaged upon Check-in, Guest shall inform Management immediately

Exhibit A – Rental Rules

  1. Smoking is NOT allowed inside the unit. Please use designated smoking area outdoors on the beach and pool deck
  2. People other than those in the registered Guest party may not stay overnight in the property. Any other person in the property is the sole responsibility of
  3. All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners or Property Managers are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
  4. Being located on an island, please conserve utilities (electric & water) whenever possible. Please be mindful of excessive electricity use. Turn off air conditioning and lights when not in the unit. Do not keep doors or windows open if air conditioning is in keep the property and all furnishings in good order Only use appliances for their intended uses.
  5. No pets are allowed, sorry.
  6. Kayaks, Paddle Boards are available for guest use. All equipment must be signed out with Property   Management, and a waiver signed. Please return all boats, boards to their storage areas, and return all paddles & life vests to a staff member when finished. Do NOT leave equipment on the beach
  7. Pool: No running on the Pool Decks. No Diving at any time. There is no lifeguard on
  8. Water and Septic: The property is on a septic system. The septic system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH anything other than toilet No feminine products should be flushed at anytime.
  9. Storms:If there is a tropical storm or hurricane, no refunds will be given unless:
    • The state or local authorities order mandatory evacuations in a “Tropical Storm/Hurricane Warning area” and/ or
      • A “mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning” area of residence of a vacationing guest.
      • The day that the authorities order a mandatory evacuation order in a “Tropical Storm/Hurricane Warning,” area, we will refund:
      • Any unused portion of rent from a guest currently registered;
      • Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted; and
      • Any advance rents collected or deposited for a reservation that is scheduled to arrive during the “Hurricane Warning”

House Rules

  1. Check in time is 3:00pm. Check out is 11:00am.
  2. Quiet time is from 10:00pm until 7:00am. During these times we ask that you bring your conversations inside and shut your doors. Sound carries easily outside, and we want to ensure everyone can sleep peacefully.
  3. Pool hours are from 7:00am until 10:00pm.
  4. Please rinse sand off your feet or shoes before entering the pool
  5. Outside music and portable speakers: Please keep music volume to a low level and also only play music suitable for all ages (no explicit or vulgar lyrics please).
  6. Air conditioning use: There are individual split style a/c units in the living room and each bedroom. They are individually controlled by remote. 24 degrees C is equivalent to 75 degrees F and is suitable for most. Please turn off bedroom a/c’s during the day, and living a/c’s off when away from the condo. Also, please turn a/c’s off if your doors and windows are
  7. Trash bins are located behind the wooden doors next to the paved cart parking. To avoid attracting pests, please don’t leave trash outside your
  8. Each condo is privately owned, so please treat our owner’s condo and furnishings like they are your own. Items are not easily or cheaply replaced on the island. Missing or damaged items will be charged to the guest’s credit card on
  9. Please report any issues with your condo or your stay to us as soon as possible so we can find the quickest solution possible.

Release & Waiver of Liability and Indemnity Agreement

In consideration for receiving permission to rent and being permitted to enter premises and the property for vacation rental or any other purpose, I hereby RELEASE, WAIVE, DISCHARGE and COVENANT NOT TO SUE the Property Management Company (Blue Caribbean Belize Management), their officers, agents, servants, or employees; the owners of the property unit premises, and the Hol Chan Reef Resort & Villas HOA (Homeowners Association), (hereinafter referred  to as RELEASEES) from any and all liability, claims, demand, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or any of the property belonging to    me, whether caused by the negligence of the releases, or otherwise, while in, on or upon the premises where the use is being conducted.

I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS the RELEASEES from any loss, liability, damage, or costs, including court costs  and attorney fees, that they may incur due to my participation in renting, whether caused   by negligence of releases or otherwise.

It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family, spouse, children and my guests. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of Belize.

I accept full responsibility for each child who arrives on the property. All children under the age of 16 must be supervised at all times.

I herby certify that he/she and guests (they) have adequate insurance to cover any injury, illness or damage that may be caused or suffered while in or upon premises, units, common grounds, ocean or any area, and agrees   to bear the costs of such damage or injury. The undersigned further certifies that he/she/they have no medical conditions which would interfere with use of sea kayaks, paddle boards, swimming, snorkeling, scuba diving, climbing stairs, etc., or else assume and bear the costs of all risks that may be created, directly or indirectly, by such condition and expressly acknowledges such physical activities are dangerous and involve the risk of serious injury and/or property damage and/or death.

I further agree to an acknowledgement of unit and grounds inspection and written acceptance such areas are safe and suited for the guests and entire party use, and further acknowledgement and acceptance that the guests and entire party will leave the premises and notify appropriate personnel in event of any unsafe situation or occurrence.

I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it, shall bind the members of my family, spouse, children and my guests, and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart    from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this Release for full, adequate and complete consideration fully intending to be bound by same.
